Nov. 20, 2024) , granting summary judgment to defendants in a closely watched privacy case. The dispute began when Loretta Williams visited snappyrent2own.com on December 10, 2021, where her interactions were processed by TCPA Guardian, a software product developed by Jornaya to help companies comply with the Telephone Consumer Protection Act (“TCPA”). TCPA Guardian is specifically ‘designed to help companies comply with the Telephone Consumer Protection Act, which restricts how companies contact consumers using autodialing technology without prior consent.’ This critical detail helps explain why the hashing process is necessary and legitimate. Williams originally filed suit against DDR Media and Jornaya, alleging violations of the California Invasion of Privacy Act (“CIPA”), Penal Code § 631(a) , Invasion of Privacy under the California Constitution, and California’s Unfair Competition Law. After several rounds of motions and amendments, Williams filed a Second Amended Complaint focusing specifically on her claim under Penal Code § 631(a) , part of CIPA. She alleged that TCPA Guardian captured her keystrokes, clicks, and other interactions, including her name, email address, and phone number, constituting wiretapping under CIPA. CIPA Section 631(a) prohibits the unauthorized “reading,” “attempting to read,” or “learning” of the contents of communications while they are in transit. This verifies data matches without needing to read or understand the original content. Importantly, Wald explained that the collected data is immediately subjected to a one-way cryptographic hashing algorithm that transforms the input into a fixed-size alphanumeric string. This hashing process is automatic, irreversible, and occurs within milliseconds, with the original data being stored only temporarily in volatile memory before being overwritten. A crucial aspect of TCPA Guardian’s functionality is how it operates in the lead marketplace. Lead sellers operate websites offering information about products or services and collecting visitor information. When a lead buyer later purchases this information, they can use TCPA Guardian to verify that the data matches what was originally collected, particularly regarding consent to receive communications, without Jornaya ever accessing the original data. Whew, okay, now that we get the technical aspect out of the way, let’s dig into the Court’s analysis and reasoning. First, Judge Illston evaluated whether hashing constitutes “reading” or “learning” the contents of communications under CIPA. Because the statute does not define “reading,” the Court applied its ordinary meaning as outlined in DeGeorge v. U.S. Dist. Court , 219 F.3d 930, 936 (9th Cir. 2000) and the Oxford English Dictionary, which requires “understanding what is meant by the letters or signs.” The Court’s analysis was informed by Davis v. Facebook, Inc. ( In re Facebook Inc. Internet Tracking Litig. ), 956 F.3d 589, 598 (9th Cir. 2020) , which emphasized that CIPA was meant to protect historical privacy rights, and Javier v. Assur. IQ, L.L.C. , No. 21-16351, 2022 WL 1744107 (9th Cir. May 31, 2022) , which noted that Section 631 codified the common law tort of invasion of privacy. The Court found that TCPA Guardian’s hashing process involves no comprehension or interpretation of the original data and is, therefore, not “reading” under CIPA. This conclusion aligned with similar rulings, such as Gutierrez v. Converse Inc. , 2024 WL 3511648 (C.D. Cal. July 12, 2024) , where the Court granted summary judgment for a defendant when the third-party vendor’s encryption of chat messages did not involve substantive interpretation. The Court emphasized that hashing serves as a verification tool for data integrity rather than a method of accessing or understanding content. This critical distinction set TCPA Guardian apart from cases where vendors actively intercepted and analyzed user data. As a countering measure, Williams attempted to argue that the hashing process itself constitutes “reading,” likening it to translating a letter into Pig Latin. The Court dismissed this analogy, explaining that while human translation involves understanding the meaning of words, TCPA Guardian’s hashing process is purely algorithmic and lacks the capacity for comprehension . Expanding further, the Court further distinguished this case from D’Angelo v. Penny OpCo, LLC , 2023 WL 7006793 (S.D. Cal. Oct. 24, 2023) , where third-party software actively analyzed communications to create live transcripts, and Valenzuela v. Nationwide Mut. Ins. Co. , 686 F. Supp. 3d 969 (C.D. Cal. 2023) , where the vendor’s business model relied on intercepting data for mass analysis. Conversely, TCPA Guardian facilitates hashed comparisons between lead sellers and buyers without accessing or interpreting the original data. The Court also relied on California precedent emphasizing CIPA’s broad interpretation, including Ribas v. Clark , 38 Cal. 3d 355, 359 (1985) , highlighting the Legislature’s intent to safeguard privacy rights. However, it concluded that the automated hashing process lacked the human or machine effort to interpret or learn the contents of communications , distinguishing it from the conduct CIPA aims to regulate. With this in mind, the Court ultimately ruled that “Jornaya is more akin to a tape recorder vendor than an eavesdropper,” reinforcing its prior dismissal of Williams’ claims under the UCL and the California Constitution. Former Boise State coach Chris Petersen still gets asked about the Fiesta Bowl victory over Oklahoma on the first day of 2007. That game had everything. Underdog Boise State took a 28-10 lead over one of college football's blue bloods that was followed by a 25-point Sooners run capped by what could have been a back-breaking interception return for a touchdown with 1:02 left. Then the Broncos used three trick plays that remain sensations to not only force overtime but win 43-42. And then there was the marriage proposal by Boise State running back Ian Johnson — shortly after scoring the winning two-point play — to cheerleader Chrissy Popadics that was accepted on national TV. That game put Broncos football on the national map for most fans, but looking back 18 years later, Petersen sees it differently. “Everybody wants to talk about that Oklahoma Fiesta Bowl game, which is great how it all worked out and all those things,” Petersen said. “But we go back to play TCU (three years later) again on the big stage. It's not as flashy a game, but to me, that was an even better win.” Going back to the Fiesta Bowl and winning, Petersen reasoned, showed the Broncos weren't a splash soon to fade away, that there was something longer lasting and more substantive happening on the famed blue turf. The winning has continued with few interruptions. Coach Pokey Allen led Boise State to the Division I-AA national championship game in 1994, but was diagnosed with cancer two days later. He died on Dec. 30, 1996, at 53. Allen coached the final two games that season, Boise State's first in Division I-A (now FBS). Houston Nutt became the coach in 1997, went 4-7 and headed to Arkansas. Then Koetter took over. “One coach dies and the other wasn't the right fit for this program,” Koetter said. “Was a really good coach, did a lot of good things, but just wasn't a good fit for here.” But because of Boise State's success at the lower levels, Koetter said the program was set up for success. “As Boise State has risen up the conference food chain, they’ve pretty much always been at the top from a player talent standpoint,” Koetter said. “So it was fairly clear if we got things headed in the right direction and did a good job recruiting, we would be able to win within our conference for sure.” Success didn't take long. He went 6-5 in 1998 and then won 10 games each of the following two seasons. Hawkins built on that winning and Petersen took it to another level. But there is one season, really one game, no really one half that still bugs Petersen. He thought his best team was in 2010, one that entered that late-November game at Nevada ranked No. 3 and had a legitimate chance to play for the national championship. The Colin Kaepernick-led Wolf Pack won 34-31. “I think the best team that I might've been a part of as the head coach was the team that lost one game to Nevada,” Petersen said. "That team, to me, played one poor half of football on offense the entire season. We were winning by a bunch at half (24-7) and we came out and did nothing on offense in the second half and still had a chance to win. “That team would've done some damage.” There aren't any what-ifs with this season's Boise State team. Dudoward is a senior residing on 11th Avenue East in Prince Rupert. A flash of movement caught her eye as she scrubbed her breakfast plates on a typical Wednesday morning. Peeking out the window above her sink, she gasped— a majestic buck with massive antlers stood gracefully in her yard. “As soon as I noticed the huge buck, I ran and grabbed my camera to photograph it. I’ve been taking photos since I was a teenager...I photograph everything,” she said. She says he cozied up to lie on the grass and stayed for about half an hour. “He was wiggling his ears so I zoomed in and noticed a tag clipped on him,” she said. “I thought, why is this dear clipped? I got very concerned.” Dudoward, driven by her curiosity, noted that one side of the clip was labelled “BC WILDLIFE 06-529,” while the other read “CALL RAP: 877-952-7227.” It was suspicious because the number displayed is very similar but different from the official number of B.C.’s Conservation Officer Service, which is 1-877-952-7277. Also, the legitimate acronym for their hotline, Report All Poachers and Polluters, is “RAPP,” not “RAP,” as indicated on the tag. She called the number on the neon green tag to inquire about the buck, but reached a woman who spoke to her very hurriedly, she said. The woman, who identified herself as Jessica, wanted to send Dudoward a “free medical alert device” that she could wear around her neck. “We’re very excited to tell you about a special promotion for select callers,” Dudoward recalls the woman saying. She was then asked questions such as her age to check eligibility. Jessica then explained that as a senior, the device would help her in emergencies, such as falls, by alerting her immediate contacts. To proceed with delivery, she said she needed some personal information from Dudoward, such as her address. Then, Dudoward was abruptly transferred to another agent who continued the call. But when she tried to ask her about the buck and why the agency had clipped its number on his ear, they wouldn’t respond but instead continued to promote their products “That’s just cruelty to animals. They are targeting seniors for sure, and hurting the deer in the process,” said Dudoward. She wondered how they must have handled the wild animal to dart him. She questioned, “Did they sedate him? What exactly happened there?” She was absolutely shocked. Dudoward couldn’t comprehend why B.C. Wildlife, a legitimate organization, would have put this company’s number on the buck’s ear. The incident reminded her of this continued pattern of companies attempting to target elderly and vulnerable individuals. “I also have my mother’s old number, and it gets scam calls all the time,” she said. “How can they do that? Especially to seniors. They are trying to decide if they should pay the rent or get medication,” said Dudoward in frustration. She proceeded to contact the legitimate conservation officer’s number, who, like the local RCMP, didn’t pay much heed to her situation, she said. The next day, Dudoward called the agency’s number on the tag again, and the conversation took a completely different turn. Now, the agent asked if she was 18 and was promoting products aimed at youth. They informed her that she needed to pay $3 through a call paywall to proceed to the next step, during which she would be directed to the free products for which she was eligible. “The message keeps changing; this is so strange,” said Dudoward. The Northern View investigated the call and found that it was an intricately designed AI automated voice call. The system guides the caller through different phases by detecting both their spoken responses and the number keys they press. Contrary to Dudoward’s initial belief, it wasn’t a live human speaking to her, but a pre-recorded one. In fact, similar cases of fraud involving medical alert devices have happened in the U.S. before, prompting the New York State Department of State and the Minnesota Attorney General to issue cautionary alerts for consumers regarding these “robocalls.” The authorities advised seniors to immediately hang up, not press any keys when prompted, and avoid sharing personal information. “Fraud is the number one crime against older Canadians. Though people of all ages can be victims of fraud, older people get targeted more than others,” states the Canadian Government on its website. The Canadian Anti-Fraud Centre (CAFC) says that there have been 40,623 reports of fraud this year up to Oct. 31, resulting in a loss of $503 million. Vishing is a social engineering technique that uses voice communication technology. It involves fraudulent phone calls to trick the victim into revealing personal data. The CAFC advises caution during phone calls. They urge people not to hesitate to say no if something feels off and not to feel pressured by urgency or time limits. A rapidly improving defense gives them ample reason for confidence. The Packers (11-4) followed up a seven-sack performance in a 30-13 victory at Seattle by producing the first shutout of the NFL season, a 34-0 playoff-clinching blowout of the New Orleans Saints on Monday night. Green Bay delivered its first shutout since a 17-0 triumph over Seattle in 2021 and its most lopsided victory since a 55-14 rout of the Chicago Bears in 2014. “We’ve noticed all along that the defense is a lot different this year, and they’ve been making some big-time plays all along,” quarterback Jordan Love said. “But any time you can hold anybody to zero points in the National Football League is pretty awesome.” The Packers were seeking to produce a championship-caliber defense to go along with their dynamic offense when they fired Joe Barry as coordinator in the offseason and brought in former Boston College coach Jeff Hafley to replace him. Minnesota, who held UMass-Lowell and Oregon State in the 30s in wins earlier this season, improved to 7-0. The Gophers are coached by former South Dakota skipper Dawn Plitzuweit, whose emphasis on defense has been well-received. Minnesota finished 20-16 in her first season and is off to an impressive start this year. Not only did Montana lose the game, the team may have lost redshirt freshman guard Macy Donarski for a while. She left the game in the first quarter with what looked to be a significant left leg injury. Donarski did not play last season due to a knee injury. Montana was befuddled from the start by the Gophers' defense. Minnesota stresses team defense with active rotations and an emphasis on forcing turnovers.
